Please read this page carefully. By using this website, submitting a form, purchasing a program, or picking up any product from Viva Institute, you agree to everything below.

1. Who we are

Viva Institute ("Viva," "we," "us") is a wellness practice founded by Nelli Berberyan. These terms are an agreement between you and Viva Institute and apply to our website, our programs, our products, and our communications with you.

2. Wellness services, not medical care

Viva Institute provides wellness services, coaching, lab testing coordination, and general information. Nothing on this website, in our materials, or in our conversations is medical advice, diagnosis, or treatment. Using this site, submitting a form, purchasing a program, or communicating with us does not create a provider and patient relationship or any other professional medical relationship. You should always consult your own licensed healthcare provider before beginning, changing, or stopping any protocol, supplement, or product, and about any condition or symptom you have. Never disregard or delay professional medical advice because of something you read or heard from us. This site and our services are not for emergencies. If you think you are having a medical emergency, call 911 immediately.

3. No guarantees

Every body is different. We do not promise, guarantee, or warrant any particular result from any program, protocol, product, or service, including but not limited to changes in energy, sleep, weight, performance, any lab marker, or any biological age score. Anything we share about the experiences of others is illustrative only. Your results, if any, may differ or may not occur at all.

4. Programs, payments, and refunds

Our programs run for a set length of six months. Pricing is shown at enrollment or quoted during your consultation, and payment is due as agreed at enrollment. Except where the law requires otherwise, program fees are non-refundable once your program has started. If your program is billed as a recurring subscription, it renews as agreed at signup and can be cancelled ahead of the next renewal by emailing us. If a payment fails or is reversed, we may pause services until it is resolved.

5. Products and shipping

Peptides and supplements are shipped directly to the address you provide. You are responsible for giving us an accurate shipping address, and for products once they are delivered. Store all products as directed. You agree to use any product only as directed, to keep products away from anyone they were not provided for, and to stop use and contact a licensed healthcare provider right away if you experience any concerning reaction. You are responsible for telling us, and your own provider, about anything relevant to your use of a product, including other things you take.

6. Assumption of risk

Participation in any wellness program, protocol, or lifestyle change carries inherent risk, and reactions to any supplement or product can never be fully predicted. By choosing to participate, you voluntarily accept those risks to the fullest extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, Viva Institute, its founder, and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to our website, programs, products, or services. To the maximum extent permitted by law, our total combined liability for any claim will not exceed the amount you paid to Viva Institute in the six months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Disputes

If something goes wrong, talk to us first at elevate@vivainstitute.net and we will try in good faith to resolve it. Any dispute we cannot resolve informally will be settled by binding arbitration on an individual basis in Los Angeles County, California, under the rules of the American Arbitration Association. You and Viva Institute each waive the right to a jury trial and the right to participate in a class action. These terms are governed by the laws of the State of California.

9. Your information

Information you share with us is used to schedule, communicate, and provide your services. We do not sell your personal information. Please do not include sensitive details in website forms; save those for your consultation.

10. Changes to these terms

We may update this page from time to time. The date above shows the latest version, and continuing to use our site or services after a change means you accept the updated terms.
